A British court has ordered a refuse collecting company to pay a total of £350, 000 in fines and costs, after the death of one its workers who succumbed to his injuries when a heavy recycling bin landed on his head.

The victim, David Ives, was an employee of Veolia ES (UK) Ltd, which was formerly known as Onyx UK Ltd. Mr Ives was engaged in collecting waste outside a pub in Easington when the tragic accident occurred on May 5, 2004.

The case was heard at the Aylesbury Crown Court where it was revealed that Ives was killed when a recycling bin slipped from the hoist on the truck and hit him on the head.

The HSE brought charges against the employer Veolia ES (UK) Ltd in the case. Following the court proceedings, the company was asked to pay a fine of £130,000 and costs of £220,000 after the jury found it guilty of contravening sections 2(1) and 3(1) of the Health and Safety at Work etc. Act 1974.

HSE inspector Dennis MacWilliam said that the accident, which left Ives’ wife a widow, could have been prevented if the company had followed safety guidelines. MacWilliam pointed out that the prevailing law required that employers keep their equipment in good shape and safe for use by workers. He added that the 1,100-litre recycling bin, which killed Ives, fell from the hoist on the lorry because it had been improperly secured.
